What Are the Penalties for this Charge?
The penalty for this charge includes a fine from $150 to $300. The administration also charges a surcharge of $365. In addition to that, your license will be revoked for six to nine months. Before your license is reinstated, you will have to agree to install the ignition interlock device in your vehicle, which you are required to pay for.
The penalties do not include a jail sentence unless a passenger in the vehicle was under the age of 16 or the offender caused an accident with bodily injuries. In that case, these will be criminal offenses.
Penalties for OWI with an Underage Passenger
If you were arrested on this charge while driving with someone under the age of 16, the penalties are even more severe. The fine would be from $300 to $1,100. You will also be required to keep the ignition interlock device in your vehicle for as short as one year or as long as 18 months. You may also have to serve a jail sentence from five days to six months.
In addition to the penalties listed above, the court may also want to reduce the possibility that you will be arrested on this charge again and order you to attend an Intoxicated Driver Program. After the program, you will need to complete a risk assessment. If the assessment suggests that you require further treatment, you will be ordered to obtain it.
