Current Wisconsin marijuana laws make it illegal to possess and use marijuana, both for medical or recreational purposes. However, many of Wisconsin’s neighboring states have legalized the use of medical marijuana: Minnesota, Illinois, Michigan, and Ohio.
Does this mean that Wisconsin residents can travel to these states for a med card and bring it back for use in Wisconsin? Well, not quite - and here’s why.
Wisconsin Residents
Typically, you have to be a resident in the state in which you are applying to get a medical marijuana card. So, for the most part, Wisconsin residents would not be able to obtain a medical marijuana card in another state. Because Wisconsin does not allow medical marijuana use, it would still be illegal in the state you are using it in as well.
Out-of-State Visitors
Several states have “reciprocal agreements” that allow you to use a medical marijuana card in another state, including Arizona, Delaware, Maine, Michigan, Nevada, New Hampshire & Rhode Island. However, those using these cards must follow the particular laws of the state they are in. Therefore, if someone is visiting Wisconsin and has a medical marijuana card in another state, it would still be illegal to use marijuana within this state.
Wisconsin may be one of the next states to pass legislation regarding the legalization of medical marijuana. However, until then, only “cannabidiol in a form without a psychoactive effect” is permitted for medical use for certain patients.
